Please carefully read these Terms and Conditions ("Terms" or "Terms and Conditions") before using or purchasing from the Neonify.com.au website ("Site", "Website", or "the Website") or engaging with the purchasing system, customer support, or other services ("the Service" or "Service") provided by Neonify ("us", "we", or "our").

Neonify® Website Terms & Conditions

By accessing or using the Website and Service, or by purchasing Products from Neonify via the Neonify.com.au website, over the phone, email, in person, or through any other means, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Website or Service.

Eligibility

You must be at least 18 years old to use this Website. If you use Neonify.com.au on behalf of a company, entity, or organisation, you must be an authorised representative with the authority to bind it to these Terms and Conditions.

Changes to these Terms and Conditions

We may modify the Terms and Conditions periodically. Any changes will be posted on this webpage with the date of the latest revisions. You should review these Terms regularly, as any modifications will be binding on you upon posting. Your continued use of the Website after changes are posted signifies your acceptance of the new Terms.

Information Posted

Commentary and other materials posted on, or via, our site are not intended to amount to advice on which reliance should be placed. We disclaim all liability and responsibility arising from any reliance placed on such materials, and any services provided therefrom, by any visitor to our site, or by anyone who may be informed of any of its contents and we make no representations or warranties that use of such materials will not infringe intellectual property rights of any third parties.

We attempt to be as accurate as possible when we describe products and services on our site, however, to the extent permitted by applicable law, we do not warrant that the product or service descriptions, colors, information or other content available or offered on our site are accurate, complete, reliable, current or error-free, nor do we make any warranty about the standard or quality of any of the products offered via our site.

 

Website Availability

We reserve the right to modify, update, or discontinue Neonify.com.au at our discretion, at any time, for any reason, and without notice or liability.

Product Availability

Neonify Products are made to order, including those in the Website shop section. We strive to meet the stated timeframe but make no guarantees due to potential external issues. Customs clearance may extend delivery times for some countries.

All orders for products are subject to availability and in this regard, in the event of supply difficulties or because products or materials are no longer in stock, we reserve the right to give you information about substitute products of an equal or higher quality and value which you can order. If you do not wish to order such substitute products, we will refund any monies that you might have paid and/or inform you when the product is in stock.

We reserve the right to withdraw any products from our site at any time and/or remove or edit any materials or content on our site. Whilst we will make our best efforts to always process all the orders, there may be exceptional circumstances which mean that we may need to refuse to process an order after we have sent you an order confirmation, which we reserve the right to do at any time, at our sole discretion.

Purchases

If you wish to purchase any Product or utilise any Service available through this Website, you may be asked to provide relevant information such as your name, email address, delivery address, and payment details. For detailed information on our data collection and usage, please see our Privacy Policy.

Neonify reserves the right to change prices and delivery schedules at any time.

While we take care to ensure that all prices quoted on our site are accurate, errors may occur. If we discover an error in the price of any product you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be treated as cancelled and if you have already paid for the product you will receive a full refund. We are under no obligation to sell the product to you at the incorrect (lower) price (even after we have sent you an order confirmation) if the pricing error is an obvious typographical or arithmetical inaccuracy and could have reasonably been recognised by you as such.

Neonify reserves the right to refuse or cancel orders at our discretion. You will be notified of any such refusal or cancellation, along with the reason, within a reasonable timeframe.

Payment and Invoicing

Payment for all signs and products ordered through the Neonify online shop and the Design Your Sign tool are processed at the point of sale. Payment options include PayPal and major credit cards. In Australia, Afterpay is also available for installment payments.

Bespoke Signs Designed by Us - Full payment is required before production begins. After design approval, an invoice will be sent via email, payable via PayPal or major credit cards. Production will start once payment is received.

Our Design Service

We offer a complimentary design service, providing one or more designs for your approval at no additional charge. If you wish to amend or cancel your order before production starts, we offer a partial or full refund. Once a custom sign order is approved and production begins, refunds are no longer available.

Returns & Refunds

Neonify offers returns and refunds only for faulty products. In line with Australian Consumer Law, resolutions for faulty products, including refunds for the cost of the product and/or shipping, are determined on a case-by-case basis depending on the fault.

To initiate a return, contact us at info@neonify.com.au with a short video and photos of the issue. Both a video and photo(s) are required for diagnostic and quality purposes. Without both, our ability to resolve your issue is limited. Once all required information is received, we will work to resolve the issue. If a return is agreed upon, the faulty product must be returned in its original condition within 21 days of receipt. If a replacement is agreed upon, we will produce and ship it as soon as possible. If a refund is agreed upon, we will notify you of the expected timeframe.

Neonify® Warranty

Neonify products include a two-year warranty covering electrical components when used appropriately. Indoor signs are not suitable for outdoor use or in wet conditions. Inappropriate use voids the warranty. Unless otherwise confirmed, all items produced by Neonify are intended for indoor use only.

Warranty Coverage for Hard Wired & Installed Signs

Neonify is not responsible for any costs incurred during the installation and/or uninstallation of your sign. If a fault is suspected, we may request photos and videos for diagnostic purposes and may require the sign to be returned for repair or replacement. If your sign is hardwired by an electrician, it is at our discretion to determine if the fault is covered under the warranty.

Damaged in Transit

We recommend inspecting your Neonify parcel upon delivery. If your sign is damaged in transit, we will provide a resolution. Damage must be reported within 21 days of delivery to be eligible for a replacement. Damage or faults reported after this period will follow our general returns and refunds policy and will not be covered under warranty. The delivery date is the courier delivery date, found in your tracking email.

If you believe your item is damaged in transit and you are within the 21-day claim period, email info@neonify.com.au with:

  • a clear photo of the damage to the sign,
  • a clear photo of the box and any damage to the outer box,
  • a clear photo of the shipping label on the box.

Lost, Missing & Stolen Signs

Neonify uses a premium express shipping service requiring a signature on delivery to ensure safe delivery. If you opt-out of the signature requirement through the shipping service, Neonify is not responsible for lost, missing, or stolen parcels marked as ‘delivered’ by the shipping service.

Our Liability

The materials, content, product descriptions, standards, quality, and specifications displayed on our website, as well as any related links or references to products or services, are provided "as is" without any guarantees, conditions, or warranties regarding their accuracy, completeness, reliability, currency, or fitness for any specific purpose. To the fullest extent permitted by law, Neonify, along with its directors, employees, and associated third parties, expressly exclude:

  • All conditions, warranties, and other terms that might otherwise be implied by statute, common law, or equity.
  • Any liability for any direct, indirect, or consequential loss or damage incurred by any user in connection with our site, products, or services, or in connection with the use, inability to use, or results of using our site, any websites linked to it, and any materials posted on it. This includes, but is not limited to:
    • Loss of income or revenue
    • Business interruptions
    • Loss of profits or contracts
    • Anticipated savings
    • Data loss
    • Loss of goodwill
    • Wasted management or office time
    • Any other loss or damage of any kind, however arising, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

This limitation does not affect our liability for death or personal injury resulting from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

We acknowledge that the laws in certain jurisdictions, including Australia, may imply warranties or conditions or impose obligations on the supply of goods and services through our site which cannot be excluded, restricted, or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the relevant jurisdiction's law, and in Australia to the extent permitted by the Competition and Consumer Act 2010 (Cth), our liability is limited. If any liability remains, it will be limited to any one or more of the following at our sole discretion:

  • In the case of goods, the replacement or repair of the goods, the supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or supplying equivalent goods.
  • In the case of services, the supply of the services again or the payment of the cost of having the services supplied again.

Furthermore, our maximum aggregate liability for any claim will not exceed one hundred and fifty dollars (AUD$150.00). You agree to indemnify Neonify, its directors, employees, and representatives from and against all actions, claims, suits, demands, damages, liabilities, or costs (including legal costs) arising from, or directly or indirectly related to, your use of our site or any products or services accessed via our site.

Additionally, when ordering items, you will be required to provide payment details. By entering your payment details, you warrant that the payment information you provide is valid and correct and confirm that you are the person referred to in the billing information provided.
